برائے نام جمہوریت اور سینیٹ الیکشن
سیاست کے بھی اپنے قواعد و ضوابط ہوتے ہیں اور معاملات اسی کے تحت چلتے ہیں لیکن پاکسان میں گنگا الٹی بہتی ہے۔ سیاسی قاعدے اور قانون پر سختی عمل درآمد نہیں کیا جاتا بلکہ کئی مرتبہ انہیں مکمل نظر انداز کر دیا جاتا ہے۔ اس کی تازہ ترین مثال سینیٹ کے انتخابات ہیں جس میں بہت کچھ غیر معمولی ہوا۔
سینیٹ پارلیمان کا ایوان بالا ہے اور یہ 1973 کے آئین کے تحت وجود میں آیا۔ سینیٹ پارلیمانی جمہوریت کا ایک اہم جزو ہے جس کا مقصد غیر ضروری اور تیزی کی جانے والی قانون سازی پر نظر رکھنا ہے۔ مختلف معاملات پر ایک معیاری اور تعمیری بحث کرنا ہے لیکن کچھ عرصے سے سینیٹ کے معیار میں بھی گرواٹ آئی ہے۔
سینیٹ قومی اسمبلی اور صوبائی اسمبلی کی طرح تحلیل نہیں ہوتا بلکہ اس ارکان تو اپنی چھ برس کی معیاد ختم ہونے پر ریٹائرڈ ہو جاتے ہیں تاہم سینیٹ ایک تواتر کے ساتھ قائم رہتا ہے۔ بدقسمتی سے یہ ایوان صرف دو مرتبہ تحلیل ہوا، پہلے اُس وقت جب جنرل ضیاء الحق نے مارشل لاء لگایا اور دوسری مرتبہ جب جنرل پرویز مشرف نے اقتدار سنبھالا۔
سینیٹ کی کارکردگی اپنے شروع کے برسوں میں تو بہترین رہی لیکن وقت کیساتھ مخلتف نوعیت کے اعتراضات سامنے آتے رہے۔ ان میں سے ایک ہارس ٹریڈنگ کا الزام سامنے آیا۔ اس ایوان کیلئے سیاسی خاندانوں کے افراد کو نوازا گیا۔ جو کچھ ہوا اس سب سے ایوان زریں کہلائے جانے والے ایوان کی ساکھ بھی متاثر ہوئی۔ پیپلز پارٹی کے سابق رہنما گلزار احمد خان نے جب پارٹی سے راہیں جدا کی کیں تو پھر وہ اور ان کے بیٹے بڑی آسانی سے سینیٹر بن گئے۔ یہ وہی دور جب پیسے کے بل بوتے پر سینیٹر منتخب کی کہانیاں گردش کرنے لگیں۔
سینیٹ میں منظور نظر افراد کو جگہ ملنے لگی اور اس فورم میں من پسند افراد کو اکامودیٹ کیا جانے لگا۔ یہاں تک کہ ایک صوبے کے افراد کو دوسرے صوبے سے امید وار کھڑا کیا گیا اور انہیں سینیٹر منتخب کرایا گیا۔ پیپلز پارٹی اور مسلم لیگ نون دونوں نے اسی طرح ایک صوبے سے تعلق رکھنے والے سیاست دانوں کو دوسرے صوبے سے کامیاب کرایا ہے۔ اس طرح صوبوں کی نمائندگی کو نظر انداز کر دیا جاتا ہے۔
اس مرتبہ 2024 میں سینیٹ کے انتخابات میں اُن افراد کو آزاد حیثیت میں کامیاب کرایا گیا جن کا مسلم لیگ ن، پیپلز پارٹی اور ایم کیو ایم سے کوئی تعلق نہیں تھا بلکہ ان افراد کو اپنے پارٹی رہنماؤں پر ترجیحی دی گئی۔ اس نئی روش نے جہاں بہت سے لوگوں حیران کیا وہیں بہت سارے مایوس بھی ہوئے۔
پہلی مرتبہ نگران حکومتوں کے سربراہ آزاد حیثیت سے سینیٹر منتخب ہوئے۔ جی بالکل نگران وزیر اعظم انوار الحق کاکڑ اور نگران وزیراعلیٰ پنجاب محسن نقوی بھی سینیٹر بن گئے۔ سابق نگران وزیر اعلیٰ پنجاب کو تو وزارت داخلہ بھی مل گئی۔ جہاں تک اورنگزیب رمدے کا تعلق ہے تو اس کی ماضی میں بھی کئی مثالیں آسانی سے مل جاتی ہیں جیسے وزیر خزانہ شوکت عزیز، حفیظ شیخ اور شوکت ترین کے نام نمایاں ہیں۔
تحریک انصاف کے سابق رہنما سینیٹر فیصل واوڈا بھی اب دوبارہ سندھ سے سینیٹر بن گئے ہیں۔ وہ آزاد حیثیت میں منتخب ہوئے ہیں لیکن پیپلز پارٹی اور ایم کیو ایم نے ان کی بھرپور غیر مشروط مدد کی ہے۔ انوار الحق کاکڑ، محسن نقوی اور فیصل واوڈا کے انتخاب نے سیاست میں ایک نئی ریت کو جنم دے دیا ہے۔ اب کسی سیاسی جماعت سے وابستگی کے بغیر سیاسی جماعتوں کی طرف سے آزاد امید وار کا مکمل ساتھ دینے کی روایت شروع ہوئی اور سیاسی جماعتیں اس کام کیلئے کسی بھی حد جا سکتی ہیں۔ اس کے لیے کسی اصول، قاعدہ یا قانون کی پیروی کرنا ضروری نہیں ہے۔
پیپلز پارٹی نے اپنے سینیئراور زیرک رہنما میاں رضا ربانی کو سینیٹ کیلئے ٹکٹ نہیں دیا۔ اسی طرح مسلم لیگ ن کے بارے میں یہ خیال کیا جا رہا تھا کہ رانا ثناء اللہ خان کو سینیٹ میں لائے گی لیکن وہ بھی پارلیمان کے دونوں ایوانوں یعنی ایوان بالا اور زریں میں سے کسی کے رکن نہیں بن سکے۔ رانا ثناء اللہ خاں کہتے ہیں کہ محسن نقوی نے وزیر داخلہ بننے اکتفا کیا ورنہ وہ کچھ اور بھی بن سکتے ہیں۔ سابق وزیر داخلہ کا یہ بیان خود اُن کی جماعت مسلم لیگ نون کیلئے ایک پیغام ہے۔
اس مرتبہ عام انتخابات کی طرح سینیٹ کے انتخابات پر اعتراضات اٹھائے گئے ہیں۔ تاریخ میں پہلی مرتبہ سینیٹ کے انتخابات مکمل نہیں ہوسکا۔ خیبر پختونخوا کی مخصوص نشستوں پر ارکان کے حلف نہ اٹھانے کی وجہ سے سینیٹ کی 11 نشستوں پر انتخابات مؤخر ہوگئے۔
ایوان کے مکمل نہ ہونے کے باوجود چیئرمین اور ڈپٹی چیئرمین سینیٹ کے انتخابات آج نو اپریل کو ہو رہے ہیں۔ اسی نکتہ کو بنیاد بنا کر تحریک انصاف نے اسلام آباد ہائیکورٹ سے رجوع کیا ہے۔ تحریک انصاف کے بقول نامکمل ایوان کی وجہ سے چیئرمین اور ڈپٹی چیئرمین سینیٹ کا انتخاب نہیں ہوسکتا۔ تحریک انصاف نے اپنی درخواست میں استدعا کی ہے کہ ایوان مکمل ہونے تک سینیٹ کے چئیرمین اور ڈپٹی چیئرمین کا انتخاب روک دیا جائے۔ اب فیصلہ عدالت نے کرنا ہے لیکن اس کے ساتھ ساتھ جمہوری ادارے میں بیٹھنے والوں کو اس نکتہ پر غور کرنا چاہیے کہ نامکمل ایوان سے سینیٹ کے عہدے داروں کا انتخاب کرانا سے جمہوریت کا فائدہ ہوگا؟
کسی بھی انتخاب میں کسی فریق یا سیاسی جماعت کی طرف سے اس کا بائیکاٹ کرنا ایک سیاسی چال ہوسکتی ہے لیکن گیارہ سینیٹرز کو ان کے چیئرمین اور ڈپٹی چیئرمین کے انتخاب میں ووٹنگ کے حق سے محروم رکھنا کسی طور بھی جمہوری روایت سے مطابقت نہیں رکھتا اور اس سے جمہوریت کی کوئی خدمت ہوگی۔ جمہوریت کے استحکام اور جمہوری اداروں کی ساکھ کیلئے ضروری ہے کہ جمہوری روایات کی پاسداری کی جائے بصورت دیگر برائے نام جمہوریت سے کسی کا کوئی فائدہ نہیں ہے۔
